Question of the Day March 15, 2014 Is failing to disclose critical facts about compounding preparations the same as a material mispresentation or misleading of the facts? What are the critical facts that should be disclosed? What warnings should pharmacies and their employees (including marketing and sales reps) be required under state laws to disclose? Should pharmacies be liable (civil and criminal) for the failures to disclose of their employees? Is this an area that lawyers have failed to explore and that will be developing in the future?
