OSBP vs. Trinity Apothecary #99-6362 – Case No. 1222:
The Board was called to order by President Dudley to hear the case of Trinity Apothecary.
Tesh Patel, D.Ph. and owner of Trinity Apothecary was present and chose to appear without Counsel.
Chief Compliance Officer, Cindy Hamilton testified for the Board. Assistant Attorney General, Brinda
White prosecuted for the Board.
Ms. White presented the Board with the Complaint for review. The Respondent had been
charged with multiple violations of state and federal regulation and rules including shipping
prescriptions into the state without an Oklahoma license and without submitting those prescriptions that were CDS to the Oklahoma Prescription Monitoring Program (PMP). The Respondent has since obtained a non-resident pharmacy license in the State of Oklahoma.
Motion was made by Dr. Greg Adams and seconded by Dr. Dorothy Gourley that based on the clear and convincing evidence presented the Respondent be found guilty on all five (5) counts.
Motion passed on roll call vote.
Motion was made by Dr. Greg Adams and seconded by Dr. Dorothy Gourley that the
Respondent’s license be placed on probation for three (3) years until October 24, 2016. The
Respondent is ordered to pay a fine of $3,000.00 per count for a total of $15,000.00 which is due on November 15, 2013. The Respondent must immediately obtain a license from the Oklahoma Bureau of Narcotics and Dangerous Drugs (OBNDD) and send a copy of this license to the Board. The
Respondent is to do late reporting of filled scripts for CDS to the OBNDD PMP. Motion passed on roll call vote.
