Man taking unapproved AIDS drug FDA is challenged over Compound Q

I doubt he is "in custody". As long as he doesn't sell/distribute unapproved new drugs in the USA, the FDA will leave him alone. Using a drug personally, he might do better or worse (or no effect). Be might live "in spite of the drug" as opposed to this Compound Q being responsible for saving his life. He might die quicker than expected, but this Compound Q might had nothing to do with his increased morbidity/mortality. There is no way one could know.
