Sue,

Here is how the fraud works with these "COMPOUNDED PAIN CREAMS" - and why a sales rep can make "$50,000 - $500,000" a year:

1. The compounding pharmacy buys raw "active pharmacy ingredients" from Medisca, Letco Medical, PCCA, etc.

2. Medisca and these other companies set artificially high "Average Wholesale Prices (AWP)" for these ingredients, but then sell these ingredients for 1/10th the price (or lower) to the compounding pharmacy. So, a pharmacy may have ingredients in a compounded pain cream that have an AWP of $2,800 for a month supply (360 grams of cream), but their cost is less than $300 for that same medication.

3. These compounding pharmacies then bill insurance, including Medicare Part D, "the full price" based upon these artificially inflated AWP prices.

4. Some insurance companies pay 50 - 90% of the billed charges - thinking they "got a deal", but in reality, they got "exploited for financial gain", because the AWP price lists have nothing to do with reality.

5. This is very similar to the scams that were uncovered by T. Mark Jones, from a Key West Pharmacy - seeing how mainstream drug companies (Pfizer, Novaratis, etc) would increase the AWP to insane levels to make a "better spread" for the doctor (or pharmacy) to make money. A great link to that story is here: http://www.bloomberg.com/news/2013-08-13/florida-pharmacists-win-597-million-blowing-whistle-on-scheme.html

6. I am tempted to do what this guy did, who made $597 million as his part of the settlements with these companies under the False Claims Act. It would take a bit of work to get the AWP price lists from these Active Pharmaceutical Ingredient wholesalers, and then find out the "real prices" they charge compounding pharmacies, but for a couple hundred million dollars, it would be worth it. Frankly, I rather that these pharmacies just stop exploiting patients, their insurance companies, and the federal government.

Medicare Part D does not pay for API-based compounds. If CMS paid, someone made a mistake, opportunists exploited a loophole, and others did not catch it. The contemporary (non-medically necessary) compounding business model is based on marketing the spread, only instead of elevating wholesale AWP, they drop the bottom out of acquisition cost (purchasing API is much cheaper than purchasing FDA-approved finished drug products). If reimbursement is available under a payer model for experimental drugs/API-based compounds, then the model Dr. Woliner describes is indeed highly lucrative. And illegal?
